Kentucky CAPA rules
Two prescribing agreements: To prescribe non-scheduled legend drugs, a Kentucky APRN enters a CAPA-NS with a Kentucky physician in the same or a similar specialty and notifies the Board through the nurse portal. Controlled substances also require a CAPA-CS and a separate request for controlled substance authority. For that you upload a current Kentucky DEA registration and proof of a KASPER (PDMP) master account (KRS 314.042). APRNs who don't prescribe need neither agreement.
First-year and early practice rules: In your first year of controlled substance prescribing you must be employed by a health care entity or provider, and an APRN employer must already hold a CAPA-CS exemption. You must also meet your CAPA-CS physician at least quarterly to review your reverse KASPER report. For the next three years those meetings are twice a year. Written records of each meeting must be kept by both parties for one year past the agreement, and the Board can audit them.
Exemption after four years: After four years of prescribing non-scheduled legend drugs you can file to discontinue the CAPA-NS. After four years of prescribing controlled substances you can request a CAPA-CS exemption through the portal, with your DEA registration, KASPER account and CAPA-CS on file, the fee paid and good standing. APRNs endorsing from other states with more than four years of prescribing may also qualify.
CE and compact: Every Kentucky APRN needs at least 5 contact hours of pharmacology CE each year from November 1 to October 31. APRNs with a DEA registration and KASPER account must take at least 3 of those 5 hours in pain management or addiction disorders. Your national certification satisfies the 14 contact hours for RN renewal. Kentucky is a Nurse Licensure Compact state for RN licenses, and APRN licensure stays with the Kentucky Board of Nursing.
